Free Sage Advice About The Defense Base Act From DBA Lawyer Bill Turley
This is the voice of experience here. Whether you hire my firm or not, you really need to follow this advice. You are going to see that most lawyers don’t want to give out this kind of advice, because they want you to think that you have to hire them first.
When you have a legal case, nothing is more important than your believability. Because at the end of the day, you have a court case. Nothing is more important than whether the Judge believes you and your story. That is why you have to guard your credibility like a hawk. Of course, the first thing you do is always tell the truth. What you may not realize is the insurance company is working hard to destroy your credibility. Many good honest folks fall for the insurance companies tricks and traps.
Don’t ever give a recorded or written statement. The insurance adjusters and their investigators and lawyers are trained and schooled into asking leading and slanted questions that make folks say things and imply things that they don’t mean to say. Talking to these insurance company suits is like trying to pet a rattlesnake. Most folks get bit and the venom can be deadly for your case.
Don’t ever sign any employment releases, medical releases or such. The insurance company is not looking for reasons to pay your benefits. They are only looking for ways to deny your claim. Don’t go there. And if you did sign these forms. Your should tell your lawyer ASAP.
I also recommend that you don’t sign the LS-203 - claim form. The LS-203 is the claim form that begins your DBA case. At our office, an attorney will always be the one signing the form.
Another thing you need realize that everything gets magnified and poked and prodded when you bring a legal case. Therefore you need to be extremely accurate and truthful about what you tell your doctor. In every day life it is no big deal to exaggerate or fudge, etc. with your problems and/or symptoms. Not so when you have a court case. Therefore you need to be 100% honest with your doctor and everyone else.
Being seen by the insurance company doctor if fraught with peril. They call it an “Independent Medical Exam.” There is nothing independent about this doctor. This doctor is paid to destroy your case. This is when you need a seasoned Defense Base Act lawyer the most. You should always lawyer-up before attending these exams so yo can be ready for their tricks and traps.
Your Free Choice of Physician Under the Defense Base Act
Under the DBA, you have what is called a “free choice of physician.” This is probably the second most important decision that determines whether you will win or lose your case. Next to hiring the right lawyer, nothing else is more determinative of winning or losing than choosing the right doctor.
If you choose unwisely and the doctor is either not a patient advocate (read: calls it the way they see it, rather than leaning toward the insurance company - that is, the company that pays them); it is very difficult - though not impossible - to get your case back on track.
How do I Find the Right Defense Base Act Attorney?
The DBA is an extension of the Longshore and Harbor Workers Compensation Act. The Longshore Act is the federal workers’ compensation program for longshoreman, harbor workers and shipyard workers. This is all part of the maritime law. Almost all of the very best DBA lawyers in America are all Longshore lawyers.
All of the best, most experienced lawyers handling civilian contractors claims have been handling Longshore Act cases for years.

You need to make sure the law firm you hire is the real deal and not some law firm that hires a good internet company is able to get on the first page of Google. I always recommend that folks hire the best lawyer they can - even if that lawyer is pretty far away from where they live.
How long have they handled DBA cases?
You want and need a law firm that specializes in civilian contractor cases. The law firm needs to have been handling these cases for a long time.
Have lawyers at the law firm been awarded Super Lawyers?
Super Lawyers is an independent organization that only awards the very best lawyers with this honor. Lawyer can’t “buy” this award. There is a very selective system where Super Lawyers are nominated and chosen by the other Super Lawyers.
What are the lawyers Avvo.com rating?
Avvo.com is another independent organization that rates lawyers. Does the senior partners in the firm have a “10" Avvo.com rating?
Have the senior partners been elected to leadership positions in important trial organizations?
Organizations like the trial lawyer organizations (in some States/ locations they are called Associations for Justice or Consumer Attorneys) have elections where the best lawyers choose their leaders. These organizations know the good lawyers from the bad lawyers.
Have local magazines names the senior lawyers as the best lawyers in their communities?
Not all lawyers are the same. Unfortunately, some lawyers give the profession a bad name. Usually, when the local press names lawyers as the best in their respective areas, these are the best, most honest lawyers. You can’t “buy” these kind of distinctions.
