A Must Watch Video For All Overseas Civilian Contractors

The Defense Base Act provides benefits to injured employees working for defense contractors outside of the continental United States. In recent years there have been thousands of defense base act workers seriously injured in Iraq and Afghanistan. If you are an employee of a civilian contractor injured while working under a US contract anywhere in the world, your claim falls under the Defense Base Act.

The Defense Base Act is different then almost every other workers compensation scheme. Unlike other workers compensation programs, under the DBA an injury is covered, even if your injury didn't happen while you were working. The term "injury" means accidental injury during the course of employment or while you're overseas. If you get sick or hurt in country or in theater, then you are most likely covered under the Defense Base Act, even if your injury occurred during recreational activities.

Generally, you must file a Defense Base Act claim within a year of the date of your injury or when you stop receiving medical benefits. However, there are many exceptions so you should contact a seasoned DBA lawyer as soon as possible.

Under the Defense Base Act there are 4 different  and distinct categories of disabilities:

Category I - Temporary Total Disability

Category II - Temporary Partial Disability

Category III - Permanent Total Disability

Category IV - Permanent Partial Disability

Once you have a DBA injury, you're at war with the DBA insurance company.  No matter how nice the DBA claims adjuster is to you, their job is to keep you from getting medical benefits and money. When you must speak with them always beware but remain polite. You don't want to be rude and give them incentive to deny benefits.
