Local VS. Internationally Known
The first question you got to ask yourself is: "Are there any DBA specialized lawyers in my area?" Being in Wyoming, the answer is probably "no". Don't get me wrong, there may very well be some of the best DBA attornies out in Cheyenne, Casper, Laramie or Rock Springs I just haven't heard of them. Being the owner of one of the top two DBA law firms in the world, I should have heard of them. It's my job.
The good thing about hiring a local attorney is that they are close to you. You can speak to them any time of the day, grab a beer with them at the local bar, or they probably know your sister or brother. The bad thing about hiring one of these lawyers out of Cheyenne or Casper is that they have little to no experience with the DBA. This is going to result in you settling for far less than you deserve. A lot of our clients come from these bad experiences with incompetent attornies asking us to patch up their case. This isn't a fun situation for anyone.
I have been working with DBA cases since before civilian contractors were being sent over to Iraq and Afghanistan to aid in the war effort. Injured Linguists and ex-military service men were coming from overseas back to San Diego, California and they were being immediately referred to my firm.
Before I was taking on DBA cases I was and am representing shipyard workers protected by the Longshore and Harbor Workers Compensation Act. The Defense Base Act is an extension of the Longshore Act. Same law, same judges and similar rules. So it makes sense why these serverely injured men and women were coming to me seeking help. Now I am leading one of the top two biggest DBA Law Firms in the world.
Let's Talk Numbers
One of the reasons that hard-working folks like you are hesitant to hire an very well-seasoned DBA attorney is the cost. Don't hesitate.
First: You don’t have to pay us any money to hire us.
Second: You will never, ever pay us any money directly to us in order for us to handle your DBA case.
Instead, we only get paid if we win your case. But even then you DO NOT have to pay our legal fees. We will ask the Judge or the Department of Labor to approve our fees. Once approved, our legal fees have to be paid by the DBA insurance company.
Usually, we receive our attorney fees in addition to the compensation you get from the DBA insurance company.
One exception to this rule is if the DBA insurance company makes a settlement offer where the attorney fees are to be deducted from the settlement. You have the right to reject such offer. Very rarely will it make sense for you to agree to having our attorney fees deducted from your settlement.
The bottom line is the DBA insurance company should be paying our legal fees, not you.
One of the main incentives the Defense Base Act provides to DBA insurance companies to pay DBA claims in a timely basis is the awarding of attorney fees. The logic is the DBA provides a “stick” to compel the DBA insurance company’s to pay benefits in a timely basis. If the DBA insurance company pays your claim voluntarily and provides you all the benefits to which you are entitled, then the DBA insurance company is not required to pay legal fees to Claimant attorneys.
