The Defense Base Act is administered by the United States Department of Labor.  The Department of Labor (DOL) puts out a Defense Base Act Summary by Insurance Carrier. In the Cumulative Summary (since 2001), Insurance Company of the State of Pennsylvania / AIG is listed as having the most DBA injury cases.

Insurance Co. Of The State Of Penn. is also known as AIG. AIG is a long time player in the Defense Base Act world.

AIG/ Insurance Co. Of The State Of Penn. exploded from having a modest DBA book of business to being the major player in the field after civilian contractors were flooded into the war zones in Iraq and Afghanistan.  At one time, AIG controlled more than 75% of the DBA insurance market.

AIG is an acronym for American International Group Inc.

Chartis - Defense Base Act 

In 2008 American International Group Inc. (AIG) collapsed in the financial meltdown. The U.S. government bailed out American International Group Inc. and the company began using the name Chartis, Inc. 

In 2012, American International Group Inc. has begun using the AIG name as its brand again.

According to AIG’s Defense Base Act website - they have “Unparalleled Defense Base Act Experience... We’ve seen more Defense Base Act claims since 2001 than any other carrier.”

Having had one of the two largest Defense Base Act law firms representing overseas civilian contractors, I can tell you first hand that what AIG says on their website is correct. My law firms have had more cases with AIG than any other DBA insurance carrier.

You have to tell the truth 

A Defense Base Act case is a court case. If you're unable to settle your AIG Defense Base Act case, then you will have to win your case at a trial. The most important part of your DBA trial is whether the Judge believes you or not. We're talking about your credibility. If the Judge doesn't believe you, then you will lose your DBA case. 

Nothing is more important to your case than your credibility.  What you may not realize is that AIG is going to have tricks and traps for you. I suggest that you don't think that just because you're telling the truth and you have a legitimate claim, that you have nothing to worry about.  That wouldn't be wise. Well meaning folks like you falls for AIG's tricks and traps all the time. They either say something or do something that will end up tanking their DBA cases. 

Avoiding these mistakes is easy - if you identify them before hand hand. Trying to fix the problem afterwards can and will cost  you a lot of money and heartache. 

Lay of the land

Make no mistake about it, AIG is an insurance company. They are all about making profits.  The more money they pay for your claim - the less profits they makes. Thus, they are looking for reasons to deny your claim and/or pay you less money for your claim. No matter how nice the adjuster is to you, their job is to find reasons not to pay you the money you deserve under the law. Not that this gives you license to be mean, short or rude to the AIG adjuster. You must be nice to the adjuster. Always. 

But know this.  Everything you say to the AIG adjuster can and will be used against you in court.  They are trained to make you say things that they will later try and use against you.  This is one of the reasons why you should be spending time hiring the best honest DBA lawyer that you can find that will take your case. 

AIG is going to hire a lawyer that is going to defend them. They are going to hire doctors that will almost undoubtedly say one or more of the following: that you weren't injured overseas, that you aren't injured as bad as you say you are, that you're fine and able to return to work and/or you're faking or exaggerating your injuries and/or disability. 

Yep, they're going to attack you. It happens in almost every case. This is why it's so important for you to tell the truth about everything. This is why it's important that you be accurate about everything. It's oftentimes the little things where they trip you up. 

It's all about winning your case and getting the medical and money benefits you deserve- strength vs. weakness 

It's my job to tell you what you need to in order to win your case. If you want fairy tails, magic pixie dust and smoke blown, then you are in the wrong place. If you want to hear the facts of life and what you're going to need to do in order to get the money and benefits for you and your family, then you're in the right place. 

The way you are going to win your case is by being honest, making sure you are accurate, making sure that you don't make case ending mistakes, and marshaling the evidence that you need in order to prevail at trial. The way you are going to win your case is being prepared to go to trial and win. Hoping for a settlement is not the way to settle your case. The way to get a good settlement is being prepared to win.  Having the evidence you need.

Defense Base Act Coverage

The Defense Base Act was established in 1941 with the primary goal to cover workers on military bases outside the United States. The Act was amended to include public works contracts with the U.S. government for the building of nonmilitary projects abroad including dams, schools, harbors and roads.

Today, almost any contract with an agency of the U.S. government, requiring work outside the U.S., whether military in nature or not, will likely require Defense Base Act coverage.
