Are you an overseas injured worker?  In this article I explain workers compensation for government contractors.
 
If you injured overseas while working under a government contract or State Department contract then you’re probably covered under the Defense Base Act.
 
The Defense Base Act provides workers compensation benefits for overseas injured workers.


Defense Base Act Claims

If you’re an overseas injured worker and, you are working overseas under a U.S. military or other U.S. government contract and suffer an injury or contracted an illness - - you may be thinking to yourself:
 
What do I do now?
How do I proceed?
Who can I trust? 
Should I talk to the DBA insurance adjuster and if so, what should I say? 
How am I going to be able to support my family if I can't the same money I was as an overseas civilian contractor? 

These questions are the first things that may come to mind for overseas injured workers and there begins the stress of not knowing where to go from there and how to get the help you need. 
 
Here,  I  give practical advice in easy to understand English.  My job is to try and make a stressful situation as straight-forward as possible. You have a court case


The first thing you need to know is that a Defense Base Act case is a court case. It is you against the Defense Base Act insurance company.

The Defense Base Act insurance company is a for profit company. Meaning, every dime that they pay you comes right out of their profits.  At the end of the day, the DBA insurance company is looking for reasons to deny your Defense Base Act claim. 

I realize that this is cynical and it is probably the last thing that you want to hear. But, my job is to tell you like it is - not like you might want to hear it.
 

Don’t get fooled by the fact that you have a “workers' comp” case

Yes, a Defense Base Act case is a workers’ compensation case. However, the benefits under the DBA are more than almost any state workers' compensation system.
 
Because of that, you can expect the DBA insurance company to not pull punches. They are going to do whatever they need to do in order to defend your workers' comp case. Meaning, they are going to do whatever is necessary to keep from paying you the DBA benefits you’re entitled to under the law.

Don’t think for one minute that just because it’s a workers’ compensation case that getting benefits will be a walk in the park. It’s more akin to a legal battle.
 

Nothing is more important than your credibility

A Judge is going to decide your case. The DBA insurance company is going to attack your credibility and character. Because of this, you need to make sure that you tell the truth about everything.

The DBA insurance carrier is hoping that you’ll lie, fudge, exaggerate about your claim.  They will use this against you in order to attack your credibility. You should depend on it.

The DBA insurance company is going to try and trick you and trap you into screwing up your DBA case. One of the main subjects I cover in my 5 Star book is how to avoid the DBA insurance company’s tricks and traps.


What is the Defense Base Act?

The Defense Base Act is supposed to provide workers' compensation benefits to civilian employees working outside the United States on US military bases or under a contract with the U.S. government for public works or for national defense.
 
I say supposed to" because the Defense Base Act insurance companies regularly deny legitimate claims. This is why you need to be prepared in order to win your DBA case.

A position of strength

Hopefully, you will be able to settle your DBA case and get a lump sum settlement. You will be able to do this if you negotiate from a position of strength.  Being ready, willing and able to win your case in court is how you are able to do this. 

The way you are going to be able to win your DBA case

The way you are going to be able to win your DBA case is to be ready, willing and able to win your case in court.
 
You do that by first avoiding the DBA insurance company’s tricks and traps. You can do that by getting a copy of my book - Win Your Defense Base Act Case and following all the do’s and don’ts that I cover in my book. 

Second, is that you put together strong and convincing evidence that you will need to win your overseas civilian worker case.

Before you do anything related to your DBA case - including, but not limited to - talking to the insurance adjuster, signing any forms (do not sign any forms, releases, etc.!!), giving a statement (don't give a statement!!!), going to your next medical appointment, attending an informal conference, attending a Labor Market Survey meeting, giving a deposition, attending a defense medical exam (also called an IME)... or anything else related to your DBA case - -

The DBA insurance company lawyers and adjusters are trained to take advantage of you. Good, well-meaning, honest folks with legitimate claims fall for their tricks and traps every day. Know this: At every step the DBA insurance company is looking for reasons and excuses to deny your claim.
 
Don't think for a minute that just because you have a legitimate injury and a legitimate case that they are going to treat you any different.
