Injured on a Whale Watching Tour?

Each year, around 26,000 gray whales make the 10,000 mile journey from the Arctic Sea south to Baja and back. In fact, the gray whale's trip is the longest migration undertaken by any mammal.

The California coastline is one of their passing points during their migratory trek to and from the frigid Arctic waters to the warm water lagoons of Baja California, where the females give birth to their calves.

When a whale watching tour results in serious injury, then the vessel owner may be legally liable for your injuries.

Under general maritime law, the vessel operator owes the passengers a duty of reasonable care under the circumstances. If the vessel owner breaches this duty of care to the passengers and the breach of duty was a cause of injuries, then the vessel owner is liable for the passenger's injuries.

Typical Injuries on whale watching vessels:

- Slip and Fall
- Trip and Fall
- Open Hatchway Fall
- Negligence by a Crew Member
- Gangway Injuries
- Objects Falling onto Passengers
- Rules of the Road Violations (Navigational Rules Violations)
- Going Too Fast over Wakes - Causing Injuries
- Assaults by Crew Members
- Weather/ Wave related Injuries
- Sinkings
- Collisions

Whale Watching Jones Act Lawyer / Crew member Injuries

If you were injured as a crew member on a whale watching tour vessel we can help.

Disclaimer (and great advice for all accident victims):

This article is not legal advice. I am simplistic in order to achieve clarity. Any resemblance to actual cases or events is purely accidental. Nor are we suggesting these injuries occurred on any particular vessel or company. Whenever you bring a claim for personal injuries and you are asking for money your credibility is always at issue. If the jury believes you are lying to them, you will lose.

Never lie about anything when you are asking for money in court. The insurance company will catch you in the lie. Depend on it. Then you will lose. Always tell the truth. You need a lawyer that is always going to tell the truth.

Where Should You Hire An Attorney?

California Allows Seaman To FIle Jones Act Cases In California - Even If You Were Injured or Were Working In another State!

Many of the big shipping companies and fishing companies regularly recruit workers from California to work on their vessels. When they get seriously hurt, they get shipped home.

When the injury is serious, what should you do?

We recommend they call us. Many times we can bring claims for these seaman in California State Court. Flying back and forth from distant ports can really add up the costs of a lawsuit. When you bring your case in California State Court, you in effect, level the playing field between you and the insurance company.

The last thing the insurance company wants you to do is file your claim in California State Court. By doing so, you are taking away the shipping companies or fish processing companies big advantage - - making you file a claim in their state.

Thus, if you are from California and you were injured in another State or working for a shipping company or fish procession company from another state - - you should call us. If you call an out of state attorney they are most likely going to file your claim in their state.

If you call us, we are going to try to keep your case here in California. In your home court - not the insurance companies home court. Call us first.

Forum Selection Clauses

At times, lawsuits and claims must be filed where the incident occurred or, for example, pursuant to a forum selection clause, in cities far removed from where the claimant resides. Thus, we accept cases with clients that live all over America and the world. The Turley Law Firm has a world-wide practice.

Somtimes seaman may get injured in another State and there is a forum selction clause which states the lawsuit must be filed in California.  In these instances, we may represent Seaman and crewmembers that come from states and/or ports very distant from California.

Based upon the foregoing California venue rules and  forum selection clauses, we accept cases for injured Seaman that are injured all over America, including:
