Meal Breaks for Restaurant Employees


Is your employer automatically deducting time from your paycheck for meal breaks? Is so, it is illegal under California law if you are working through all or part of your meal periods.

The auto-deduct practice is fraught with monitoring difficulties that make it very difficult for employers to monitor and still comply with California law. In most cases, an employer is not in a position to ensure that workers take the full meal break without interruption.

For example, UPS recently entered into an $87 million class action settlement with 20,000 drivers who claimed UPS automatically deducted standard meal periods from wages.
