Currently, a case is pending before the California Supreme Court - Brinker v. Superior Court - in which the Court will determine what an employer must do to "provide" a meal period. Employers argue that to "provide" a meal period, all that is required is to make it available to employees, which, according to employers, is satisfied through providing a paper policy to employees advising them of the meal period requirement when working over 5 hours and/or 10 hours. The position taken by the employees in Brinker is whenever a meal period is not received when the law requires one, the employer has failed to provide a meal period in accordance with California law, and the employer owes the employee an hour's worth of pay.
Although what it takes to "provide" a meal period will be decided in the near future, this much seems to be true. An employer who does nothing more than provide a paper policy advising employees of their meal period rights, and who knows or should know that employees are routinely not receiving meal periods has likely not provided a meal period under either side of the Brinker coin.
