Disabilities Under the DBA

Under the Defense Base Act, there are four different and distinct categories of disabilities:

1. Permanent total disability;
2. Temporary total disability;
3. Permanent partial disability; and
4. Temporary partial disability.



Nature of Disability and Extent of Disability

One of the big issues at your Defense Base Act trial is going to be the nature and extent of your disability. Nature of disability is different from the extent of disability. Nature deals with the duration of the disability. Temporary and permanent go to the nature of the disability.

On the other hand, extent of disability concerns the degree of the disability. Total and partial go to the degree (read: extent) of the disability. Under the DBA, scheduled injuries are different from unscheduled injuries.
