San Diego Workers Compensation Attorney - Worker Death

Under California Workers Compensation Law, when an injury or illness causes or contributes to the death of an employee, the surviving dependents are entitled to recover death benefits.

The amount of the death benefit is affected by the date of the injury and the number of persons dependent upon the deceased employee for financial support. There are a number of rules affecting how much you will receive for the death of a family member.

Here are some of the rules for deaths after January 1, 2006:

One total dependent: $250,000
Two total dependents : $290,000
Three or more Total dependents: $320,000

If there are minor children they may be eligible for continuation of benefits until they reach 18 years of age.

If there is one or no surviving total dependent, partial dependents may be entitled to some benefits.

In addition, burial expenses are payable up to $5,000.00.
