Your Employer Does Have to Pay You For Your Work!
Most workers work hard for their employers. They are conscientious, devoted and diligent. Some workers will routinely stay late or work from home in order to keep the boss happy. If you find yourself constantly working from home, or checking your e-mail while you are on a meal period, or showing up early for your shift, then you may have a claim for unpaid wages.
California Unpaid Wages Claims
Under California law, your employer has to pay you for all the time that you work. If you are working and you are not getting paid, then your employer is violating California's strict wage and hour laws. Here are some of examples of common unpaid wages claims that we see:
- Employees reporting to work early so that they can put on their mandated work clothes, such as protective suits/ clean suits.
- Employees checking their work e-mail during meal periods.
- Employers that require employees to keep their beepers or cell phones on during meal periods or after hours.
- Employees starting wotrk before they clock in or working after they clock out.
- Employers requiring employees to drive a company truck to and from home each day - without making any personal stops, personal calls or running any errands during the commute - and not being compensated for the drive time.
- Employees having to stand in line at a time clock before their shift starts in order to clock in for the work period.
- Employees who are expected to show up 10 - 15 minutes prior to their shift to turn on the lights, set up tables, put signs out, redirect the phones, etc.
- Employers rounding time forward for employees who punch in early for shifts, and rounding back time for employees who punched out late after a shift.
- Employers that tell employees that they can't be paid for working over 8 hours in a day.
- Employers that require employees to wrongfully certify that they didn't work hours that they, in fact, worked.
- Employees in the computer and/or electronics industry who are misclassified as exempt and illegally expected to work unpaid overtime.
- Salaried retail employees who are required to work unpaid overtime while spending most of their time on the sales floor working alongside the hourly employees.
