California Overtime Laws

Under California Wage and Hour Laws, the basic rule is that your employer must pay you one and a half (1.5) times your "regular rate" if you work:

1) more than 8 hours in one day,
2) more than forty (40) hours in one week, or
3) for working a seventh consecutive day in any workweek.

If you work more than twelve hours in a single day or works in excess of 8 hours on the seventh consecutive day then your employer must pay you double (2x) your regular rate for that extra time worked.

Your "regular rate" under California law is calculated by dividing your total compensation by the statutory maximum of 40 hours per week.

Under California law, your remedies include being able to go back up to four years and includes waiting time penalties of your daily rate times up to 30 days.
