Why do you think that the company wants to take your statement?
Do you think that they want to take your statement in order for the company to pay thousands of dollars in medical benefits, temporary total disability benefits, temporary total disability benefits and permanent disability? Of course not. The company takes your statement in order to find ways to deny your claim?
3. Do not chose a doctor until you have consulted with an experienced maritime law firm.
Under both the Longshore Act, State of California Workers’ Compensation Laws and the Jones Act (seamen) - the choice of a treating physician is the second most important decision affecting your rights to benefits.
For example, almost every worker on the waterfront has “concurrent jurisdiction.” That is, they have more than one case.
We can not over express the importance of this in many instances. Often times, concurrent jurisdiction is used to raise low maintenance rates or obtain vital medical treatment.
Injured maritime workers (whether shipyard workers, Longshore or Jones Act Seamen) have two cases. For shipyard workers that is a Longshore and Harbor Workers’ Compensation Act case and a State of California Workers’ Compensation Appeals Board (WCAB) case.
Thus, it is crucial that you are treated by a doctor who is not a company doctor. Do not waste this decision.
4. Consult with an experience maritime law firm
Injuries on the waterfront or navigating waters fall under a unique area of law: Maritime law.
Maritime law is a very, very specialized field of law. Do not make the mistake of hiring a law firm which specializes in State of California Workers’ Compensation or general personal injury. You are strongly recommended to hire a law firm that specializes in maritime (shipyard work, LHWCA, longshoremen, Jones Act Seamen, passengers on vessels, etc.)
Your case is too important for you to hire an amateur. Do not be fooled. Ask your lawyer how many maritime workers’/cases they have handled in the past, are currently handling how many maritime trials they have done, and how many published articles that they have. You must have someone to fight for you that knows unique maritime law. Otherwise, the company lawyers will chew up and spit out your state workers’ compensation lawyer.
