Rest Periods

In addition to meal periods, California law requires that employees are entitled to 10 minute paid rest periods whenever they work over 3 and one half hours in a day. If an employer does not permit employees to take rest periods as described above, California law entitles the employee to one hour's worth of pay at the employee's regular rate of pay.

As they handle meal periods, employers argue they have permitted rest periods by simply taping a piece of paper in the employee break room that advises them of their California rights to rest periods. This, however, does not cut it.

Like meal periods, if an employer does nothing more than provide employees with a piece of paper and knows or should know that employees are not able to take 10 minute rest periods, the employer has not complied with the law and owes the employee the extra hour of pay. Likewise, if an employer requires the employee to clock-out for the rest period, meaning the employee is not paid for that time, the employer has not complied with the law and owes the employee an extra hour of pay.
