Navigable waters

It's simple. If you can drive a boat from the location to the open ocean, then it is navigable waters of the United States. If you can drive a boat from one State to another State - then you are in navigable waters of the United States. If you are injured on a vessel in the navigable waters of the United States, then usually maritime law will apply to your case.

Passengers on Yachts

Under maritime law, the vessel owes its passengers with the duty of reasonable care under the circumstances. Oftentimes, violations of Rules of the Road are used to establish liability in yachting accidents.

Crew members on Yachts

Crew members aboard yachts are usually Seaman. Generally, if 30% of your total work time is aboard a vessel or vessels, you will qualify for Seaman Status. Meaning you are eligible for Jones Act Seaman benefits. Which are the most powerful remedies of any workers in America.

Are you a Sieracki Seaman?

Otherwise, you may qualify as a Sieracki Seaman. This means you work less than 30% of your time aboard vessels and your work does not qualify for the Longshore and Harbor Workers Compensation Act.
