Under the LHWCA (aka Longshore Act), an injured worker has the right to bring a civil lawsuit against the third party. A third party is any entity or person other than the employer who is legally responsible for the injured workers injuries.

Negligence

The third party case can be based in negligence. For example, a subcontractor employee that is injured by scaffolding that was negligently installed or maintained by someone other than the workers employer.
