What Should I Do If I Am Not Getting Proper Medical Treatment For My Work Injury?

Under California law, your employer has "medical control" for the first 30 days. This means that you must see the workers compensation insurance company doctor for the first 30 days following your work injury. After that, you have some options.

The first thing you need to ascertain is whether your employer/ insurance carrier has a Medical Provider Network.


What is a Medical Provider Network?

A Medical Provider Network (MPN) is a group of health care providers set up by an insurer or self-insured employer and approved by DWC's administrative director to treat workers injured on the job. Under state regulations, each MPN must include a mix of doctors specializing in work-related injuries and doctors with expertise in general areas of medicine. After you submit your workers' compensation claim form, once the insurance company or your employer provides you timely with their list of MPN doctors, you must select your workers' compensation treating physician from the MPN.

Medical Provider Networks (MPNs) are required to meet access-to-care standards for common occupational injuries and work-related illnesses. The regulations also require MPNs to follow medical treatment guidelines established by the Division of Workers' Compensation (DWC) and allow employees a choice of provider(s) in the network after their first visit.


How Can I See Another Doctor For My Work Injury?

MPNs must offer an opportunity for second and third opinions if the injured worker disagrees with the diagnosis or treatment offered by the treating physician. If a disagreement still exists after the second and third opinion, an injured worker may request an independent medical review (IMR).

What this means to you is that you need to get the list of doctors in your employer's / insurance carrier's MPN. Once you have the list you can usually find another doctor on the MPN list that is acceptable. Then you need to request a second opinion with that doctor. Once you have the second opinion, then you can request to have the second opinion doctor become your primary treating physician.
