Excel Industries, Inc. Mower Roll-Over Accident
In 1993, Excel Industries, Inc. manufactured the Hustler 4400 and sold the mower in California. The Hustler 4400 had neither a roll bar or a seat belt. At the time it was sold, the Hustler 4400 tractor was illegal for use on any work site in California.
Excel Industries offered the roll bar as an option. Excel believed that the inclusion of a roll bar and seat belt would raise the price of the mower. Since customers didn't want to pay for safety, a roll bar was not a standard item.
Trouble is, the mower needs a seat belt as much as a car. The mower needed a roll bar as much as a car needs a roof to protect the occupants. The CPSC, the industry, industry consultants, the manufacturers and certainly Excel Industries, Inc. and Hustler Turf Products, Inc. had knowledge of all the mower roll-over injuries and deaths.
When safety is offered as an option, then people believe that it's not really needed. After all, its an option. So, few customers know what Excel Industries and Hustler Turf Equipment know. Few customers know about all the deaths and injuries caused bu mower roll overs. But Excel Industries, Inc. and Hustler Turf Equipment know.
Tragically, a local San Diego County worker was using Excel Industries, Inc. mower - a Hustler 4400, and he was seriously injured when he was ejected from the cab of the Excel mower and was run over by the mower. Now he faces a lifetime of brain injury, severe crushing injuries. A lifetime of disability.
If only Excel Industries, Inc. had sold a safe mower. By making a roll bar and seat belt "an option" Excel Industries, Inc. is manufacturing and selling defective and dangerous tractors. You might remember this the next time you go to buy a mower for your lawn.
