Defense Base Act Law - Life Time Medical Treatment For DBA Injuries
In the typical DBA case we see - - the injured worker has a permanent disability. In these cases, it is clear that the injured DBA worker is entitled to lifetime medical treatment for their DBA related injuries. However, what about the injured DBA worker that has no permanent disability - do they also get lifetime medical treatment for their DBA injuries?
Before we address this question. Let’s back up a step. Remember, there are two different types of injuries under the Defense Base Act - scheduled and non-scheduled injuries. With scheduled injuries (legs, feet, arms, hand, hearing loss) - if you don’t have a permanent disability - then you would oftentimes not need lifetime medical. But that is not always the case.
One instance we have seen is with hearing loss claims. Very high tone hearing losses are not compensable under the DBA. (That being said, most of the folks that contact us with DBA related hearing loss - have permanent disability under the DBA). However, we have seen a few DBA claimants with a hearing loss - that need hearing aids - but don’t have a DBA rated permenant disability. These folks are entitled to lifetime medical benefits - even if they don’t have “ratable” hearing losses.
Where we usually see injured DBA claimants - with no permanent disability - and being entitled to lifetime medical benefits under the DBA is with non-scheduled injuries. This is because non-scheduled injuries under the DBA are based upon a loss of wage earning capacity. You can be very seriously injured under the DBA and still have no loss of wage earning capacity. It happens.
For these folks, there is no doubt that they are entitled to lifetime medical treatment under the DBA.
Can I Settle My Life Time Medical?
Lifetime medical treatment under the DBA can have very significant value. If you have private health insurance (say you got a job Stateside after your DBA injury with medical coverage) - - you might want to consider settling your lifetime medical treatment. In addition, we are all waiting to see how this whole Obama Care plan works out.
In order to get the future medical treatment you are going to have to establish that the requested services are reasonable and necessary for the treatment your DBA injury.
