We help civilian injured workers take on and beat the Defense Base Act insurance companies.  Let me explain my experience with this area of the law.  I have been representing Longshoremen and Harbor Workers since 1987.  I started by representing the seriously injured shipyard workers in the shipyards in San Diego.  Shipyard workers are Harbor workers that fall under the Longshore and Harbor Workers Compensation Act (LHWCA).  The Defense Base Act actually falls under the LHWCA, and is considered to be part of U.S. Maritime Law.

I began representing Defense Base Act workers in the late 1980's and early 1990's - - long before civilian contract workers were sent to Iraq and Afghanistan.  

We are Trial Lawyers - Not Settlment Lawyers

First and foremost, we are trial lawyers. I tried my first one of these cases in the 1980's. The only way you are going to get a fair settlement for your DBA case is if the DBA insurance company knows your lawyer has the ability and fortitude to take your case to trial and win.  If a DBA lawyer is a “settlement lawyer” - the seriously injured DBA worker will not get a fair settlement offer.  In essence, the threat of going to trial and winning is the only thing that causes DBA insurance companies to offer a fair settlement.

Strength vs. Weakness

You can't be afraid to protect your rights.  If you want to get what you are entitled to under the DBA - you have to be ready to take your case to court. You have to be prepared to win. Hoping for a good settlement is a fool's errand.  You want to and need to negotiate from a position of strength.  You don't do that unless you are prepared to win in court.
