What Are California Temporary Disability Benefits?
Temporary Disability benefits are payments you get from the California workers' compensation insurance carrier if you can't do your usual job while you are recovering from your work injury or work illness. Temporary Disability benefits are also known as "TD" benefits.
Temporary Partial Disability (TPD)
If you can do some work while recovering from your California work injury, but you are earning less than before your injury, you should receive temporary partial disability benefits. Also known as TPD benefits.
Temporary Total Disability (TTD)
If you can't work at all while recovering from your California work injury you should receive temporary total disability benefits. Also known as TTD benefits.
Salary Continuation
Some California employers have plans that pay all your wages for all or part of the time you are temporarily disabled. These plans are called salary continuation. There are different kinds of salary continuation plans. Some salary continuation plans use your vacation and/or sick leave to supplement the TD payments required by California workers' compensation law.
How Is Temporary Disability Calculated?
California temporary disability is calculated as 2/3 of your Average Weekly Wage, subject to the statutory minimum and maximums at time of injury. Meaning, you are entitled to 2/3's of your Average Weekly Wage. The current minimum compensation rate is $143.70 and current maximum compensation rate is $958.01.
Is There a Waiting Time?
A 3-day waiting period applies, which is reimbursed after the 14th day of your disability. There is no waiting period if you are immediately hospitalized.
How Long Can I Receive TTD Benefits?
Payments 2 years or more from the date of injury are subject to current statutory limits (known as the "2-year rule"). Meaning, you can usually only recover 104 weeks of TD benefits.
Do I Have to Pay Taxes on Temporary Disability Benefits?
TD benefits are not taxable.
