What is Brinker Doing wrong in California?

There are several key allegations in the case. First, Brinker California employees do not receive mandated meal periods. Employers must relieve workers of all duty to take meal breaks or pay premium wages imposed by statute. Second, Brinker has attempted to have workers illegally "waive" meal periods. However, employees cannot waive meal periods without meeting the Wage Order’s specific waiver requirements.

Brinker has tried to spin the argument that employers must "force" an employee to take a meal period. The Plaintiffs in Brinker are not trying to suggest that an employer is required to "force" an employee to take a meal period. For whatever reason the employee does not take a meal period, the Labor Code makes it clear that the employee must be paid for the time worked.

The employer is in charge of the work place. If the employee does not take a meal period, the Labor Code has a simple remedy. The employer pays one hour for each one-half hour meal break missed.

This is the bottom line. Brinker and other employers want free labor. They want a system whereby they can "game" the system. That is, have employees work through meal periods and not have to compensate them for actual time worked. No one is being "forced" to do any thing. Employees just want to be paid for services rendered.

There are very solid public policy reasons behind the California Wage Orders. Do you want the cook that cooks your next meal to be so tired from working 7 hours in a row, without a break, to use the same knife and cutting board for cutting lettuce that they also used to cut raw chicken?

Do you want the employee driving a huge garbage truck to be tired from having to drive 7 hours in a row without a meal period? There are very, very solid public policy reasons that support California’s Wage Orders. These Wage Orders don’t just protect the employees. These California Wage Orders are intended to protect your family and my family.
