Longshore Rip-Off: Oakland Ports America and Oakland Homeport Insurance: Deny The Claim First - Investigate the Claim Second

Under the Longshore Act, the employer/ insurance carrier is supposed to initially provide benefits to injured workers (called “Claimants” under the LHWCA). Then the employer carrier can investigate the claim and if the employer/ carrier finds a reason to deny the claim, then the Longshore insurance company can controvert the claim. That is, file a LS-207 Notice of Controversion. The LS-207 is then supposed to state the reason why such benefits are not being provided.

What we see every day in Oakland, California for Longshore insurance companies - particularly Ports America and Homeport Insurance is exactly the opposite. In Oakland - these insurance companies have quite literally turned this on it’s head.

Time and again, what we see is Ports America and Homeport Insurance systematically denying claim after claim. Instead of providing benefits first, deny later we see deny first, wait to pay benefits for months and months. Effectively, Ports America and Homeport Insurance are trying to intimidate legitimately injured workers from filing Longshore claims. If you can’t get paid weekly benefits promptly - many workers figure they will keep right on working, in spite of their injuries and disabilities.

It is clear Ports America and Homeport are trying to discourage workers from filing claims by denying almost every claim. Instead of receiving timely benefits, workers are then forced to litigate for basic medical treatment and weekly benefits. Instead of receiving weekly benefits at the Longshore rate, workers are forced to apply for State Disability benefits - which are slower and less than Longshore weekly benefits.

They do it because they can

It is our take that the reason why the Oakland Ports America and Oakland Homeport Insurance deny almost every claim is because they can. It is our take that in the last 5-10 years the quality of legal representation for injured Longshore workers in Oakland has been extremely disappointing.

From what we have seen, some Oakland Longshore lawyers have done nothing to stop or even hinder this practice of denying first and investigating later. Military Sealift Command ships are civilian manned, and are referred to be as being in service, rather than in commission. Some, owned by the United States Government, have the prefix USNS, standing for United States Naval Ship, whilst others, on charter or equivalent, are simply the normal merchant MV or SS. Very recently the trial court in Rogers v. Resolve Marine, 2009 U.S. Dist. LEXIS 91423 (E.D. La. Sept. 10, 2009) ruled that a Jones Act Seaman could amend his complaint to add punitive damages based upon the alleged gross, willful, and wanton negligence of the defendant in causing the plaintiff's injuries. Note this goes beyond the narrow reading that the U.S. Supreme Court's ruling in Atlantic Sounding. These pleadings go beyond the willful failure to provide maintenance and cure.

Jones Act Seaman are wards of the court. Yet the last 20-30 years of Jones Act jurisprudence has seen the protection of shipping companies and insurance companies - - not helpless Seaman. However, the tide finally appears to be changing.

Caution should be taken in how the workers compensation claim form (DWC-1) is filled out. Remember, everything that is placed on the form can and will be used against you in a court of law, namely, the WCAB or the Superior Court in a third-party case. It is best to have a seasoned workers' compensation attorney help you fill out the form. However, absent that, a few considerations should be kept in mind.

One consideration to be made carefully is statements of "fault" or "causation". Under California workers' compensation law, fault is not supposed to be an issue. For example:

Notice that a description of the incident was given: "Forklift injury." That's enough. No more information is needed. You have protected your rights.

Notice also that all known as well as suspected body parts are provided.

Jones Act Maintenance Rate Is Too Low?

How can I raise my daily maintenance rate? This is one of the most important questions for injured Jones Act Seaman. San Diego Jones Act lawyer Bill Turley teaches other lawyers about Jones Act law.

"Maintenance rate" refers to the daily rate of money an injured Jones Act Seaman receives while they not fit for duty and are receiving medical treatment for their injuries. When you finish active treatment it is usually called reaching "maximum medical improvement". This is often a battle. Some Seaman are working under a Union contract that states the maintenance rate you are entitled to. If not, then you are entitled to maintenance based upon your actual expenses.

How do I calculate my daily maintenance rate?

You can calculate your expenses by adding up your monthly money you spend on rent/ mortgage, food, utilities, insurance, etc. (i.e., monthly expenses). Then divide this figure by the days in the month. This is your daily maintenance rate in the Ninth Circuit (Jones Act Seaman in San Diego, Jones Act Seaman in California, Jones Act Seaman in Hawaii, Jones Act Seaman in Oregon, Jones Act Seaman Washington, Jones Act Seaman in Alaska). Starting A California Workers' Compensation Claim

isn't providing proper medical treatment?

If you are an injured worker in California, and your doctor isn't providing you with satisfactory medical care, you have a few options. It depends on whether you have reached Maximum Medical Improvement (MMI) / Permanent and Stationary (P&S) status. Meaning, your doctor has declared you aren't going to get any better from your injury. This article focuses on getting a new doctor before you have been released from treatment. Get a Second Opinion

If you have not been declared MMI / P&S, you can select another doctor for a second opinion on your employer's Medical Provider Network (MPN). First, you need to go on-line and find the MPN list of doctors. If you don't find it on-line, make a request in writing for your employer's MPN list.

Of course, care must be taken to actually choose the right doctor on the MPN list. This is where a seasoned workers comp attorney really helps. There are two types of life pensions:

- Permanent Total Disability
- Permanent Partial Disability

With a Permanent Total Disability life pension, you must have 100% disability.

For a Permanent Partial Disability you must have a Permanent Disability (PD) rating of 70% or more to be entitled to a life pension. You are entitled to a life pension based upon a formula using variables determined by your PD rating and your weekly earnings or wages. This is a little confusing, because you are not entitled to a life pension unless your PD rating is over 70 percent.

The first payment of temporary compensation (i.e., your workers' comp check) must be made to you within 14 days after your employer has knowledge of your injury, unless your claim has been denied. After that, you are entitled to receive your temporary compensation payment every 2 weeks from the date of the first payment.

If the workers comp insurance company doesn't pay you promptly, the late payment "must" be increased by 10%. The insurance company is supposed to pay that even if you don't ask for it.

What If My Claim Is Denied?

California Workers Compensation Law can be confusing and intimidating to seriously injured California workers. This article concerns what you should do if your claim is denied. Also known as a denied claim. First of all, just because your claim is denied doesn't mean you still can't win your California Workers Compensation Law Claim.

If your claim is denied you need to find out why your claim is being denied. Then, you need to marshal the evidence to overcome the denial. If you can "fix" your evidence then you may be able to convince the workers compensation insurance adjuster to accept your claim.

If your claim is denied, and you are not able to convince the adjuster that you have a valid claim, then you will need to file for a hearing at the Workers' Compensation Appeals Board in order to fight for further medical treatment, temporary total disability benefits and other benefits.

Generally, before you file for a hearing however, you are going to need evidence, usually medical evidence. You need evidence to fight the reason why the workers compensation insurance carrier denied your claim.

If your claim is denied because the insurance company believes that your injury is not work related, then you are going to need proof that you were actually injured at work. You may need to subpoena co-workers or others that witnessed your injury.

Neuron damage in explosion-related "mild" traumatic brain injuries can be more extensive than previously thought and is not necessarily related to the severity of clinical symptoms, researchers said.

What Should I Do If I Am Not Getting Proper Medical Treatment For My Work Injury?

Under California law, your employer has "medical control" for the first 30 days. This means that you must see the workers compensation insurance company doctor for the first 30 days following your work injury. After that, you have some options.

The first thing you need to ascertain is whether your employer/ insurance carrier has a Medical Provider Network.

What is a Medical Provider Network?

A Medical Provider Network (MPN) is a group of health care providers set up by an insurer or self-insured employer and approved by DWC's administrative director to treat workers injured on the job. Under state regulations, each MPN must include a mix of doctors specializing in work-related injuries and doctors with expertise in general areas of medicine. After you submit your workers' compensation claim form, once the insurance company or your employer provides you timely with their list of MPN doctors, you must select your workers' compensation treating physician from the MPN.

Medical Provider Networks (MPNs) are required to meet access-to-care standards for common occupational injuries and work-related illnesses. The regulations also require MPNs to follow medical treatment guidelines established by the Division of Workers' Compensation (DWC) and allow employees a choice of provider(s) in the network after their first visit.

Here are 15 tips that will help you win your Defense Base Act claim

1. You are covered by the Defense Base Act almost all the time you are overseas

You don't have to be actually working in order for your Defense Base Act claim to be compensable. In fact, we have personally seen playing soccer and basketball found to be compensable. A DBA worker that accidentally overdosed after getting a tattoo was found to be compensable under the Defense Base Act.

2. Report your injury immediately

Be sure to report it to someone in a position above yours at the company. Confirm the reporting with an e-mail and send a copy to yourself. Be sure to keep the email copy.

3. Don't give a recorded statement or a written statement

It will only be used to deny your claim. If the adjuster tells you they need your statement in order to provide you with medical treatment or weekly compensation benefits, call a Defense Base Act lawyer. Immediately. But don't give a statement.

4. Don't sign any medical releases or employment releases

If the DBA adjuster tells you they need you to sign authorizations in order to provide your DBA benefits, call a DBA attorney.

5. Wage evidence

Document all your Defense Base Act wages, bonuses, etc. Keep all pay stubs and W-2's. You earnings dtermine your compensation rate. Maximise your earnings to maximise your compensation.

6. The DBA insurance adjuster

Don't blow your relationship with the DBA insurance adjuster. Don't be gabby, but don't be rude. Be polite only say as much as is necessary. The last thing you want to do is motivate the insurance adjuster against you and your claim. On the other hand, don't get all chatty with the DBA insurance adjuster. Remember, it is just like criminal law: everything you say can and will be used against you in a court of law. Depend on it. This is anther reason to get a seasoned DBA lawyer.

7. Document medical treatment

Keep records of all overseas medical treatment. Get names, addresses and e-mail address for all medical providers. Get copies of all your medical records before you leave to return to the United States. Get copies of all imaging studies (MRI's, x-rays, CT scans, etc.).

8. Witness information

Get names, addresses, telephone numbers and e-mail address of all witnesses to your injury incident.....

Fatal Boating Accident on Lake Pillsbury

Reports indicate Gary Archer, 55, of Santa Rosa, died in boating accident on Lake Pillsbury. According to reports, Mr. Archer had been water skiing behind a Glasstron GT 150 powerboat.

According to the Lake County News:

Speckman had reportedly maneuvered the boat towards the lake's shoreline with Archer in tow, Bauman said. Speckman apparently made a sharp turn before reaching the shoreline with the intent that Archer would release the ski line and glide into shore. Somehow, Archer was struck by the boat while he was still in the water.

Five Men Killed in a Boating Accident in Cook Inlet

The men were aboard a 20-foot skiff. Co-workers soon found a body washed ashore. All five members of the group were found dead in the area of a commercial clamming camp on the west side of the Inlet.

Some of the men were from California.

Pacific Seafood is the parent company of Pacific Alaska Shellfish, which runs a Nikiski processing plant that prepares the razor clams for market. The five dead men worked for the seafood company.

Three of the dead men were discovered wearing life vests, according to the U.S. Coast Guard. Two were not.

The five Alaska clam diggers who died when their overloaded 22-foot skiff was swamped by rough seas and strong winds in Cook Inlet may not have been properly licensed, the Anchorage Daily News reported in Saturday's newspaper.

If the vessel was overloaded, then it would be unseaworthy and the employer would be negligent under the Jones Act and general maritime law.

Clam Operations Were Not Properly Licensed

The five Alaska clam diggers who died when their overloaded 22-foot skiff was swamped by rough seas and strong winds in Cook Inlet may not have been properly licensed, according to news reports. The state Commercial Fisheries Entry Commission website lists only 25 people with statewide commercial permits for harvesting razor clams with shovels. None of the names on the list match the names provided Friday by Alaska state troopers, although two have similar spellings.

Earlier reports indicate the vesselwas overloaded.

The five clam diggers were found dead in Cook Inlet.
