Under the Longshore Act, the employer/ insurance carrier is supposed to initially provide benefits to injured workers (called “Claimants” under the LHWCA).  Then the employer carrier can investigate the claim and if the employer/ carrier finds a reason to deny the claim, then the Longshore insurance company can controvert the claim. That is, file a LS-207 Notice of Controversion.  The LS-207 is then supposed to state the reason why such benefits are not being provided.

It is clear Ports America and Homeport are trying to discourage workers from filing claims by denying almost every claim.  Instead of receiving timely benefits, workers are then forced to litigate for basic medical treatment and weekly benefits. Instead of receiving weekly benefits at the Longshore rate, workers are forced to apply for State Disability benefits - which are slower and less than Longshore weekly benefits.

It is our take that the reason why the Oakland Ports America and Oakland Homeport Insurance deny almost every claim is because they can. It is our take that in the last 5-10 years the quality of legal representation for injured Longshore workers in Oakland has been extremely disappointing.

The Military Sealift Command (MSC) is a United States Navy (USN) organization that controls most of the replenishment and military transport ships of the Navy.

Military Sealift Command ships are civilian manned, and are referred to be as being in service, rather than in commission. The tide is turning for Jones Act Seaman and their damage claims. The question is what effect the United States Supreme Court's ruling in Atlantic Sounding Co. v. Townsend, 129 S. Ct. 2561, 174 L. Ed. 2d 382 (2009), has on his ability to seek punitive damages for the alleged gross, willful, and wanton negligence of the defendant in causing the plaintiff's injuries?

Very recently the trial court in Rogers v. Resolve Marine, 2009 U.S. Dist. LEXIS 91423 (E.D. La. Sept. 10, 2009) ruled that a Jones Act Seaman could amend his complaint to add punitive damages based upon the alleged gross, willful, and wanton negligence of the defendant in causing the plaintiff's injuries. Note this goes beyond the narrow reading that the U.S. Supreme Court's ruling in Atlantic Sounding. These pleadings go beyond the willful failure to provide maintenance and cure.

Jones Act Seaman are wards of the court. Yet the last 20-30 years of Jones Act jurisprudence has seen the protection of shipping companies and insurance companies - - not helpless Seaman. However, the tide finally appears to be changing.

Allowing punitive damages for injured Jones Act Seaman is absolutely the right thing to do. Shipping companies and vessel owners have been given carte blanche to injure, maim, abuse.....

Workers Compensation Claim Form - DWC-1?

Caution should be taken in how the workers compensation claim form (DWC-1) is filled out. Remember, everything that is placed on the form can and will be used against you in a court of law, namely, the WCAB or the Superior Court in a third-party case. It is best to have a seasoned workers' compensation attorney help you fill out the form. However, absent that, a few considerations should be kept in mind.

One consideration to be made carefully is statements of "fault" or "causation". Under California workers' compensation law, fault is not supposed to be an issue. However, this can become an issue, inadvertently, when a worker makes an incorrect statement of fault (that is, who caused your serious injury). Often times, injured workers may not have all the information needed to reach an accurate conclusion as to who or what actually caused their injury.

For example, it may be easy to state that a co-worker negligently operated a forklift, causing injury, because that's how it may appear at first. However, further investigation may reveal that the injury was actually caused by the forklift's defective design, and that other people have been injured or killed previously because of the same unsafe machine.

Therefore, it is usually better to keep the DWC-1 statement brief and in general terms.

For example:

"Forklift injury - amputated right leg. Also injured left leg, body, back and head. Please see medical reports for a complete report of all injuries."

Notice that a description of the incident was given: "Forklift injury." That's enough. No more information is needed. You have protected your rights.

Notice also that all known as well as suspected body parts are provided.

The part about "Please see medical reports for a complete report of all injuries" is not always necessary but is a nice detail. It lets your....

Starting A California Workers' Compensation Claim

In order to start a workers compensation claim in California, you must first give your employer "notice" of the injury, or tell them that you are injured. It depends on whether you have reached Maximum Medical Improvement (MMI) / Permanent and Stationary (P&S) status. Get a Second Opinion

If you have not been declared MMI / P&S, you can select another doctor for a second opinion on your employer's Medical Provider Network (MPN). First, you need to go on-line and find the MPN list of doctors. If you don't find it on-line, make a request in writing for your employer's MPN list.

Of course, care must be taken to actually choose the right doctor on the MPN list. This is where a seasoned workers comp attorney really helps. With a Permanent Total Disability life pension, you must have 100% disability.

For a Permanent Partial Disability you must have a Permanent Disability (PD) rating of 70% or more to be entitled to a life pension. The first payment of temporary compensation (i.e., your workers' comp check) must be made to you within 14 days after your employer has knowledge of your injury, unless your claim has been denied. After that, you are entitled to receive your temporary compensation payment every 2 weeks from the date of the first payment.

If the workers comp insurance company doesn't pay you promptly, the late payment "must" be increased by 10%. The insurance company is supposed to pay that even if you don't ask for it.
