Forklifts and OSHA

The Occupational Safety and Health Administration (OSHA) maintain a variety of measures that govern the use of forklifts for companies that fall under federal jurisdiction. According to news reports, the Coast Guard vessel was travelling at too high speeds considering the density of the vessel traffic at the time. The Coast Guard vessel collided with a recreational vessel being operated by Mr. Deweese. Anthony Cole DeWeese, 8, died due to trauma. Five others, including two younger children, were hospitalized for their injuries. The Deweese boat accident was tragic.

Bill notes that author Matt Hall accurately quoted him. All in all, it was a very accurate reporting. Matt did a really good job with the article.

Boat Accident - San Diego Bay - Coast Guard Vessel Collides with Pleasure Vessel

There was a fatal boat collision on San Diego Bay Sunday December 20, 2009. A 33 foot Coast Guard vessel collided with a smaller 20 foot recreational vessel. The boat accident was during the San Diego Bay Parade of Lights. A young boy died of trauma. According to reports, there were 13 people aboard the smaller vessel. The Coast Guard boat collision resulted in many other serious injuries.

Navigational Rules Analysis

The Rules of the Road (also known as Inland Navigational Rules) apply to vessels on the San Diego Bay. Although much is not known about the collision here are a few Navigational Rules which may apply to this collision.

Newly gathered e-mails could provide a different view on who could have prevented the deaths of six civilian truck drivers during a 2004 attack of a KBR convoy in Iraq. A Houston judge initially ruled that the U.S. Army had control over the deployment of the convoy, but new-found e-mails may point the other way. According to the Houston Chronicle, e-mails have been uncovered that suggest many KBR supervisors did not believe they were constrained by military orders - a constraint that is central to KBR's defense in the federal case. U.S. District Judge Gray Miller is expected to rule soon on whether the case will proceed to trial in 2010 or be dismissed again. What happens when I don't get a meal break?

Failing to Permit Meal Periods

Employees working more than 5 hours per day must be provided 30-minute meal periods unless they work shifts of six hours or less and agree to waive the break for that day. If the shift lasts ten hours or more, a second meal period is required.

Employers who do not provide the breaks required under California law must pay the affected employee an extra hour of pay at the employee's regular rate of pay for that day. At an hour of pay per employee per day, the liability can be substantial.

The Santa Barbara Sheriff's Department reports that the vessel Scarlet Begonia crashed on rocks of the coatst of Vandenberg Air Force Base. Apprently there was one survivor and two deceased.

Seas were reported to be 8 -10 feet.

When a vessel hits rocks it is termed an allision under maritime law. Under the Rules of the Road the Captain of the vessel has a duty to not hit rocks, etc.

Miguel worked for a Redi-Mix Company in Southern California.While Miguel was removing bags from the defective palletizer, his glove was caught in a pinch point. Several of Miguel's fingers were amputated and his hand was gruesomely scarred and disfigured. The case was especially challenging because the "designer" of the conveyor system was long out of business.

Dietary supplements are a billion dollar a year industry. According to a recent National Health Interview Survey, about 114 million people - more than half the adult population of the United States - regularly consume dietary supplements. Many supplements are sold over the Internet, but they are also sold in mainstream nutrition stores across America.

According to the Survey, the majority of people believe that supplements require government approval. Another common misconception is that supplement manufacturers are required to provide labels that include warnings about their potential side effects and dangers.

People believe that these supplements are regulated and because they are being sold in mainstream nutrition stores they are safe. Of course, nothing could be further from the truth. In reality, supplements are entirely unregulated in the United States. Many of these supplements are manufactured in China. Make no mistake about it, many of these supplements are very, very dangerous.

Importantly, the FDA has recently taken action. Federal agents recently raided American Cellular Labs in California in order to investigate allegations they were manufacturing supplements contaminated with anabolic steroids. In addition, the FDA recently raided the Boise, Idaho warehouse of Bodybuilding.com amid allegations it is selling dozens of products containing illegal anabolic steroids.

The FDA has sent a message to the supplement industry. Now, this same public health message needs to be sent to teens and young adults whom are most susceptible to this unscrupulous marketing.

Contractor Electrocuted in Shower in Iraq

CBS News reported that a 25-Year-old Contractor recently died from shoddy electrical wiring in a shower, which the article states is a widespread problem in Iraq. The article can be found at http://www.cbsnews.com/stories/2009/09/08/world/main5295738.shtml.

The article stated that electrical wiring has been an ongoing problem in Iraq. There have been at least three troops who have been electrocuted in the shower since the start of the Iraq War, while still others have been electrocuted under other circumstances such as while operating a power washer. In an effort to prevent said injuries, inspections and repairs are under way at 90,000 U.S.-maintained structures there.

Hermanson background included that he grew up in San Diego and Las Vegas. He joined the military at age 17, and did three tours in Iraq with the Air Force before leaving at the rank of staff sergeant. He returned to Iraq as an employee of the Herndon, Va.-based private contractor Triple Canopy the article reported.

As is often the case, Mr. Hermanson took the contracting job so that his family would have money to buy a house in Muncy, Pa., where they were planning to live. His family is struggling to understand how he could survive four war tours, then die suddenly in a seemingly safe place.

In July, the Defense Department's inspector general said that of the 18 electrocution deaths of U.S. soldiers and contractors in Iraq, eight involved possible equipment faults or malfunctioning that caused or contributed to the electrocutions. The accidental touching of live wires was blamed in about half the deaths.

The L.A. Times ran an article titled "Injured war zone contractors fight to get care" http://www.latimes.com/news/nationworld/nation/la-na-contractors17-2009apr17,0,5505250.story

The article discussed the fact that contractors are crucial to the U.S. military efforts in both Iraq and Afghanistan. However, when these same civilian workers are wounded on the job, they must then do battle with an insurance system marked by long delays and high costs. The article noted that more than 1,400 civilian workers have died and 31,000 have been wounded or injured in the two war zones.

The article further states that Insurance companies initially rejected 44% of claims from contractors involving serious injuries and more than half of all claims related to psychological stress. As a result, civilians maimed or traumatized in the war zone often must wage lengthy court battles for medical care and benefits.

The L.A. Times stated the high denial rate is partly due to government rules that give insurers only 14 days to decide the validity of a claim. Thus, Insurers often reject first and investigate later.

Those case-by-case investigations are usually resolved through mediation. When the two sides can't agree -- as has happened in more than 1,000 cases -- the dispute winds up in court. Workers win such appeals in 75% of cases, records show, but the process can last months or years.

AP Reports - Military contractors sued over Iraq 'burn pits'

BRETT BARROUQUERE of the Associated Press wrote an article about an Air Force veteran and a one-time contractor who served in Iraq. The two are suing military contractors Halliburton Co. and KBR Inc., accusing the companies of exposing them and others to toxic fumes by burning everything from human remains to tires in massive open-air pits.

The law suit names Houston-based companies KBR and Halliburton, as well as the Turkish company ERKA Ltd. The lawsuit is the latest on behalf of former military members and contract workers who claim they were exposed to toxins from burning waste in the warzone. At least 32 suits over burn pits have been filed in 32 states.

The article quoted Capt. Jeffrey Cox, of the Massachusetts National Guard who stated "In many ways, I consider the burn pits like the Agent Orange of the Iraq War."

The article concluded by stating that earlier this year, several members of Congress asked Veterans Affairs Secretary Eric Shinseki to investigate potential burn pit hazards. Shinseki said his agency is conducting a health study of 30,000 Iraq and Afghanistan veterans and noted the VA "has learned important lessons from previous military conflicts" as it deals with environmental exposure questions.

Many homes, apartments and/or homeowner associations use automatic sliding gates for security reasons. What most people don't realize is that automatic sliding gates are very, very dangerous to children and adults. Children and adults can be severely injured or killed if they become entrapped in the gates as they are automatically opened or closed. The injuries include cuts, broken bones, brain injuries and amputations. Many older gates do not have sensing devices or reversing mechanisms to prevent these entrapments.

Gate entrapment injuries often occur to children. 9 Reported Deaths in Total; Consumers Urged to Stop Use of Flammable Wearing Chenille Apparel Due to Burn Hazard

WASHINGTON, D.C. - The U.S. Consumer Product Safety Commission (CPSC) and Blair LLC, of Warren, Pa., are expanding Blair’s voluntary recall of women’s full length chenille robes to include additional chenille robes and three other chenille products all manufactured by A-One Textile & Towel. CPSC and Blair also are re-announcing the earlier recall of women’s robes.

In April 2009, Blair recalled 162,000 chenille robes after it learned of three robes catching on fire, including one report of second degree burns. Blair then received several reports of deaths allegedly due to robes catching fire. This prompted a second news release in June 2009 to again alert consumers to the burn hazard for the chenille robes. After this re-announcement, Blair received four additional reports of deaths allegedly due to the robes catching fire. Three of these victims were cooking and a fourth was tending a pellet stove; three of the four victims were in their 80s and one was in her 70s. All nine reported deaths occurred prior to the April 2009 announcement of the recall.

Blair has received one report involving one of the additional garments described below catching fire; no injuries have been reported related to these garments. Blair decided to expand the recall to include all women’s chenille wearing apparel manufactured by A-One Textile & Towel.

Name of Products: Full Length Women’s Chenille Robes, Women’s Chenille Jacket, Women’s Chenille Lounge Jacket, Women’s Chenille Top

Units: About 138,000; 162,000 units were previously recalled in April 2009

Manufacturer: CA-One Textile & Towel, of Karachi, Pakistan. A-One Textile & Towel manufactured all of the products recalled in April 2009. Blair is expanding its recall to all women’s chenille wearing apparel manufactured by A-One.

Retailer: Blair LLC, of Warren, Pa.

Hazard: Some of these products fail to meet the federal flammability standard and present a risk of serious burns to consumers if the garments are exposed to an open flame.

Incidents/Injuries: Since announcing the recall in April 2009, Blair has received nine reports of deaths allegedly due to the originally recalled robes catching fire. Blair has received one report on one of the additional garments catching fire; no injuries have been reported.

Taser Reverses Their Position

Reports online are stating that Taser International has dramatically changed their position in that they are now advising police agencies not to shoot its stun guns at a suspect's chest. Taser for the first time says shooting someone in the chest poses a risk of an "adverse cardiac event", which in essence, means it is dangerous. The advisory was issued in an Oct. 12 training bulletin. Taser's products are often involved in litigation regarding bad injuries and deaths of people shot with a Taser.

CPSC Issues Statement for Recreational Off-Highway Vehicles (ROVs) to Address Rising Death Toll

WASHINGTON, D.C. - Furthering its commitment to improve the safety of Recreational Off-Highway Vehicles (ROVs) and reduce the number of deaths and serious injuries nationwide, the U.S. Consumer Product Safety Commission voted to publish an advance notice of proposed rulemaking (ANPR) to address safety hazards associated with vehicle ROVs.

CPSC staff’s preliminary evaluations indicated that the vehicles may exhibit inadequate lateral stability, undesirable steering characteristics, and inadequate occupant protection during a rollover crash. The staff reviewed the Recreational Off-Highway Vehicle Association (ROHVA) draft proposed American National Standard for Recreational Off-Highway Vehicles, ANSI/ROHVA 1-200X and found preliminarily that it does not adequately address the deaths and injuries associated with ROV rollovers and collisions.

The ANPR invites written comments from the public regarding the risks of injury associated with ROVs and ways in which these risks could be addressed. Following publication of the ANPR, the public will have 60 days to provide comments to the Commission. Comments can be submitted at www.regulations.gov

While we work on new safety rules for ROVs, I urge all riders and passengers to strap on a helmet, use the seat belt, know the terrain, and never allow anyone under 16 to drive these vehicles.

Woman Injured in Boat Accident on Colorado River

We previously posted on a boating collision that occurred n the Colorado RIver where Stefani Rhoades was seriously injured. The Daily Bulletin reported that Stefani Rhoades was the girlfiend of a Mr. Beck or a Mr. Becker. That information concerning Stefani Rhoades Colorado RIver boat accident may not be correct.

The following is taken from a recent post on TOPIX:

"It was 2:45 in the afternoon. Mrs. Rhoads is not the girlfriend of the owner of the boat, she and her husband were guests of the owner. They are not "White Trash" in fact, they are business people
who were invited to spend the weekend with a friend, and chose to do so. The newspaper should probably have talked to Mrs. Rhoads or her husband to get the facts before publishing an article on the subject. The boat Mrs. Rhoads was on was not moving, they were drifting at the time when another boat hit them."

If the boat that Stefani Rhoades was a passenger was "not moving" - - that is not under power - - then the following Inland Navigational Rules / Rules of the Road may apply:

LOOKOUT (From Rule 5)
Every vessel shall at all times maintain a proper lookout.

SAFE SPEED (From Rule 6)
All vessels must proceed at a safe speed at all times. You must go slow enough to prevent a collision no matter what the conditions.

Details have emerged that there was a house party a Rancho Santa Fe mansion. The San Diego Union has reported the house party was at the home of Michael Flynn if Rancho Santa Fe, California. As a result, Alex Capozza is dead and Jamie Arnold was recently released from the hospital.

Each year, hundreds of thousands of children who hit their heads undergo CT scans to rule out serious brain injury. How do you know if your child has a serious brain injury?

There are two main causes of child acquired brain injury (ABI). First, is hypoxia: That is: deficiency in the amount of oxygen reaching body tissues. The second major cause of child ABI is traumatic brain injury (TBI).

Children with brain injuries may lack the communication skills to report headaches, sensory problems, confusion and similar symptoms. Instead, they may:

    1.     Refuse to eat

Roll Over Protective Structures - - as an option? A California Product Liability Lawyer's Take

Comments by a ROPS attorney/ California ROPS lawyer:

Tractor “Roll Over Protection Structure” (hereinafter “ROPS”) refers to operator compartment structures (usually cabs or frames) intended to protect equipment operators from injuries caused when a tractor overturns or rolls over. In case of an overturn, ROPS provide a "zone of protection" for the operator. The operator must stay within this zone; if the operator is thrown off the tractor, or is thrown partially off the tractor, he or she may not be protected by the ROPS.

Because the operator is only protected from injury if he or she remains securely in the "zone of protection," seat belts must be used when operating a ROPS-equipped tractor. ROPS have two fundamental components: the structure or frame and the seatbelt.

Seatbelts on tractors have two purposes. First, to keep the operator in the “zone of protection” in the case of a roll-over. Second, to keep the operator in the operator’s seat so that they are not thrown or bucked from the seat and then run over by the tractor.

ROPS and seatbelts are nothing new with tractors. Because of this identifiable risk of injury due to rollover or operator ejection, in 1976, the Occupational Safety and Health Administration (OSHA) required all agricultural employers to equip all employee-operated tractors manufactured after October 25, 1976, with ROPS and safety belts. 29 CFR 1926.1002. This standard is still in effect today.

In 1975 California passed Cal. Code Of Regulations Title 8, Section 3651; which required all tractors used in California to have ROPS (i.e., structure/ frame and a seatbelt).

In 1993, Excel Industries, Inc. manufactured the Hustler 4400 and sold the tractor in California. The Hustler 4400 had neither a seat belt nor ROPS. At the time it was sold, the Hustler 4400 tractor was illegal for use on any work site in California. The Excel tractor had no ROPS.

Tragically, a local San Diego County worker was using the Excel Industries, Inc. tractor - a Hustler 4400, and he was seriously injured when he was ejected from the cab of the Excel tractor and was run over by the tractor. Now he faces a lifetime of brain damage and severe crushing injuries.

If only Excel Industries, Inc. had sold a safe tractor. By making ROPS “an option” Excel Industries, Inc. is manufacturing and selling defective and dangerous tractors. You should remember that the next time you go to buy a tractor for your farm.

Federal Agents raided yet another "supplement" manufacturer. This time Boldbuilding.com. News sources report Federal agents raided the Boise, Idaho, headquarters and distribution warehouse of Bodybuilding.com yesterday amid allegations it is selling dozens of products containing illegal anabolic steroids.

A majority stake of Bodybuilding.com was reportely sold to Liberty Media, which also owns the Atlanta Braves.

Between February 2008 and last August, Robert Blenkinsop, an FDA special agent based in Boise, made four purchases from the company, he said in an affidavit filed in support of the search warrant.

Of the 31 products he bought, 23 tested positive for one or more of five anabolic steroids: madol, tren, superdrol, androstenedione and turinabol, he said in the affidavit.

Blenkinsop also said there is probable cause that the products believed to contain the anabolic steroids are "falsely and misleadingly labeled as 'dietary supplements.'"

The products purchased from Bodybuilding.com that contain the anabolic steroids are considered new drugs by federal authorities, which means they are not generally recognized by scientific experts as "safe and effective for use under conditions prescribed, recommended or suggested in the labeling," Blenkinsop said.

The U.S. Food and Drug Administration (FDA) issued a public health advisory warning consumers to stop using any body building products that are represented to contain steroids or steroid-like substances. Many of these products are marketed as dietary supplements.

Punitive damages had long been available at common law, a tradition that extended to maritime claims, including maintenance and cure claims. 46 U.S.C.S. § 30104 of the Jones Act did not eliminate preexisting remedies available to seamen for the common-law cause of action based on the right to maintenance and cure.

The Atlantic Sounding holding rests on the tradition of awarding punitive damages at common law for particularly reprehensible conduct, and the fact that the tradition extends to claims under the general maritime law. Maritime employers' obligation of maintenance and cure has been part of maritime law for centuries.

This decision is a victory for all Jones Act Seaman. The threat of punitive damages for wrongfully withheld maintenance and cure is extremely important. Propeller Accident Lake Mohave - Woman Dies

It has been reported that a boating accident at Lake Mohave killed a woman on Saturday, August 29, 2009. News reports state that the 22 year-old victim fell from a pontoon boat and was fatally struck by the vessel's propellers.

The incident occured in Gasoline Alley on Lake Mohave. According to witnesses, she fell off the bow of the boat and was struck by the propeller. In June 2008, a 58 year-old California woman was killed due to being struck a propeller while swimming in Gasoline Alley.

The Consumer Products Safety Commission has quietly granted Matel a request to have Matel's own testing labs test for lead paints under new Federal Laws which were promoted by recalls of items containing lead paint.

"It's really ironic that the company that was a principal source of the problem" is now getting favorable treatment from the government, said Michael Green, executive director of the Center for Environmental Health in Oakland.

In other words, the fox is being allowed to watch the chicken coop. Parents everywhere should feel outraged by this action. As a parent, do you trust Matel to conduct it's own self-testing? From the company that placed the health and safety of millions of children at risk? Lead toys are defective. Yet, Matel sold these defective lead toys across America.

As the parent of children and infants, one feels like screaming at the insanity. Yet, the CPSC caved on this one. Only public outrage will make the CPSC see the error of their ways.

Lutron Electronics Co. Inc., of Coopersburg, Pa., is voluntarily recalling about 245,000 Roller Shades.

Victoria Classics of Edison, N.J., is voluntarily recalling about 163,000 Thermal Sailcloth and Matchstick Bamboo Roman Shades.

Pottery Barn Kids/Williams-Sonoma, Inc. of San Francisco, Calif., is voluntarily recalling about 85,000 Roman Shades.

IKEA Home Furnishings, of Conshohocken, Pa., is voluntarily recalling about 120,000 MELINA Roman Blinds.

Lewis Hyman Inc., of Carson, Calif., is voluntarily recalling about 4.2 million ¼" Oval Roll-up Blinds and 600,000 Woolrich Roman shades.

Child strangulation due to roll-up blinds and roman shades have been well documented. These companies should not be recalling these dangerous and defective products to begin with.

Maritime law experts said that if the DeWeese family's Sea Ray wasn't anchored - as appears to be the case before the accident - it would need to have had a white light shining above the boat and navigational lights on either side of it.

If those weren't on, the Sea Ray's operators might be at least partly at fault, said Bill Turley, past president of the Consumer Attorneys of San Diego.

If they were, Turley said, questions for the Coast Guard become:

•Was there a crew member serving as lookout, as required by law?

•How fast was the Coast Guard vessel traveling?

Turley said maritime rules require boats to travel at safe speeds, which generally means slow enough to avoid hitting an object or another boat. Sunday night's crowded parade waters should be a part of any analysis, he said.

"Because of the density, the Coast Guard would have a heightened requirement to exercise slower speeds and better judgment," Turley said. "To me, if the DeWeese vessel exhibited lights, then there is no question the Coast Guard would be at fault."
