It Depends On The Circumstances of Your Case
Sometimes, pushing your Defense Base Act (DBA) case to trial is going to be the only way to get a fair outcome. If the facts and evidence in your case add up, and you can’t come to an agreement with the DBA insurance company, then it’s probably worth going to trial for the money and benefits you truly deserve. But it’s not the right option in every case, and you don’t want to make that decision on your own before you’ve gotten the real facts about your case from an attorney who wins DBA cases.
Sometimes, settling is the best choice—and the “fairest” choice under the circumstances. Taking a case to trial means that you risk “losing.” If your case isn’t “winnable,” you probably want to choose getting something over getting nothing. Don’t think that means you should accept any settlement offer that comes your way, though. The DBA insurance company might try to settle for the smallest amount possible before you know your rights or have had a chance to talk to an attorney—in other words, not every settlement offer is going to be “fair” to you. But once you have a good lawyer working on your case, the DBA insurance companies know the odds and may be more motivated to settle fairly before going to trial. The important thing is to look at the facts in your case and under the law, talk it over with an experienced attorney, and make your decisions based on the reality of your situation. While it may be possible to settle fairly, you first have to know what “fair” is for you.
“When I seek out professional advice, I don’t want B.S. I want it straight up, with no double talk. I figure you do also. I always use plain English, with no sugarcoating, no B.S. lawyer talk, and no double talk-just old fashioned, unsweetened, unvarnished truth-just the way that I would want it.” -Bill Turley
When it comes to the ins and outs of filing a DBA claim, the first step you must take, is always tell the truth. Under no circumstances should you ever sugarcoat anything. The moment you start to over-exaggerate your injury, is the moment you can kiss your case good bye. Count on it.
I have seen it happen to many hard working civilian contractors before.
Never tell a lie, and always tell the truth. Your credibility with the Defense Base Act insurance company and the Judge depend on it.
