Is it possible to settle a Defense Base Act case fairly without going to trial?

It Depends On The Circumstances of Your Case

Sometimes, pushing your Defense Base Act (DBA) case to trial is going to be the only way to get a fair outcome. If the facts and evidence in your case add up, and you can’t come to an agreement with the DBA insurance company, then it’s probably worth going to trial for the money and benefits you truly deserve. But it’s not the right option in every case, and you don’t want to make that decision on your own before you’ve gotten the real facts about your case from an attorney who wins DBA cases.

Sometimes, settling is the best choice—and the “fairest” choice under the circumstances. Taking a case to trial means that you risk “losing.” If your case isn’t “winnable,” you probably want to choose getting something over getting nothing. The important thing is to look at the facts in your case and under the law, talk it over with an experienced attorney, and make your decisions based on the reality of your situation.
