It’s All About Winning Your DBA Case With the Truth

The number one factor that determines whether you are going to win or lose your case is whether the judge believes you or not. You have to guard your credibility like a hawk.

Here is the simple truth: if the judge doesn’t believe you - then you are going to lose 99 out of 100 times. No matter how “good” the rest of your case may be.

No matter what the truth is - and sometimes the truth isn’t so pretty - you have to figure out how to win your case with the truth.

VA Medical Centers and the Defense Base Act

Many of you are ex-military and you may be able to seek medical care at your local VA Medical Center. While the VA shouldn’t be your first choice if you have a DBA injury - if your claim is denied or the DBA insurance carrier isn’t paying for your treatment - then the VA Medical Center may be you only option. But you need to understand that there are potential issues with the VA and Defense Base Act claims.

The VA is usually trying to link your injuries to your military service. With your DBA case you are going to need to link your injuries to your being an overseas civilian contractor.

At times this isn’t an issue. For example, you could be suffering from PTSD from both being in Iraq and/or Afghanistan while in the military and while a civilian contractor.

But the point here is that you need to tell the truth. If you suffered an injury while working as an overseas civilian contractor you must be straight about that. Otherwise, it can come back and tank your DBA case.

But if you had a military injury that was aggravated or accelerated by your working as a civilian contractor - that is okay. There is no “apportionment” under the DBA and you will receive full compensation as long as your injury was aggravated or accelerated by your being overseas as a civilian contractor.

The point here is don't fib in order to get VA medical center treatment if you were injured as a civilian contractor.
