"When I seek professional advice, I don’t want B.S. I want it straight up, with no double talk. I figure you do also. I always use plain English, with no sugarcoating, no B.S. lawyer talk, and no double talk - just old fashioned, unsweetened, unvarnished truth - just the way that I want it."  San Diego Charter Boat Lawyer- Bill Turley

San Diego Charter Boat Attorney Straight Talk

San Diego has a large charter boat fleet.  Truth is working on San Diego Charter boats can be dangerous.  If you were seriously injured on a San Diego Charter boat you are probably asking yourself: How am I going to get medical treatment?  How am I  going to support myself and my family while I am off work?  What is going to happen if I can’t go back to work on boats?  This website answers those questions and more.

Once you get injured on a charter boat, everything can change in an instance.  Crew members that were once friends can start to be more distant. The Captain or owner may try to encourage you not to report the injury. They may try to encourage you not to file a claim.  They might even try to pressure not to bring a claim.  Not reporting an injury and/or filing a claim is always a mistake.

This may be new to you, but it is actually quite common to us.  If this has happened to you, we can help you through the tough times. I am a San Diego Charter Boat lawyer. I have represented many, many  crew members that work on San Diego Charter boats.  You need to know the law protects you.  We can help protect you when you are being pressure not to bring a claim. We can help protect you from being blackballed if you do bring a claim.

Crew members that are injured on San Diego Charter Boats fall under the Jones Act or are what is called “Sieracki Seaman.”

Jones Act

Most crew members on San Diego Charter boats fall under the Jones Act. The Jones Act negligence is very, very different from ordinary negligence under State law. In many instances it is much easier to prove negligence under the Jones Act than in a State law claim such as a automobile accident or a slip and fall in a grocery store. Jones Act negligence is said to be the lowest form of negligence under the law. Meaning the level of negligence is much lower threshold in a Jones Act case than a State law claim.  Click here for more great free information on the Jones Act Attorney Straight Talk.

What is a “Sieracki Seaman?”

Some websites will tell you that you can only qualify for Seaman’s benefits if you permanently work on a vessel and spend over 30% of your work time on a vessel.  However, that is not the case.  You can still qualify for Seaman’s benefits as a Sieracki Seaman even if you aren’t what is called a Jones Act Seaman. Unseaworthiness

Unseaworthiness is a legal term that refers to an unsafe condition of a “vessel.” A seaworthy vessel is one that is reasonably fit for its intended use, it should be a safe place to work and live. A seaworthy vessel should be equipped with appropriate safety gear and equipment, safe recreation facilities, and a competent crew. It is the duty of the owner of the “vessel” to provide you safe place to work.   Click here for more great free information on unseaworthiness.
