The new study, "Broken Laws, Unprotected Workers: Violations of Employment and Labor Laws in America's Cities" outlines what seasoned California Wage and Hour Class Action attorneys have known for some time. California employers regularly prevent workers from taking meal periods and meal breaks. Ths study included California workers.

By and large, it is low-pay workers and foreign born workers who are most victimized by employers that steal worker wages.

The study revealed - - more than 2/3 (69%) of workers who were entitled to a meal break received no break at all, had their break shortened, were interrupted by their employer or worked during the break.

Seasoned California Wage and Hour Attorneys will tell you that under California Labor Code and California Wage Orders - - you are entitled to an uninterrupted 30 minute meal period after working a five hour shift.  Uninterrupted means not having to have a cell phone on.  Not having to answer a “quick question.”  Not having to stay on the employer’s premises.

Uninterrupted 30 minutes is an uninterrupted 30 minutes.  Anything less, requires the employer to pay you one hour of wages.  That is the wage and hour law in California.
