Nothing is more important when handling your case, then speaking the truth. People who believe if they sugarcoat their case, it will help them win more money. Wrong.
You have to be up-front, honest, and truthful to your attorney and the judge. If a judge suspects your not telling the truth, you can say goodbye to your case. Count on it. I have seen it time and time again.

Telling you what you need to hear
Believe it or not I am known as a lawyer that is brutally frank and straight-up. I am not going to tell you what you want to hear so you will hire me or like me. I am going to tell you what you need to hear in order for you to win your DBA case.

Liberty Mutual and the DBA
Liberty Mutual Insurance Company is one of the insurance carriers that provides coverage for companies that employ overseas civilian contractors. You are covered under the Defense Base Act if you are injured while working for a company while working overseas.
Whether it be Iraq, Afghanistan, the Middle East or anywhere else in the world - you are eligible for DBA benefits if you are injured.
You are at war with the insurance company
You need to think of it as trading one war for another war. You are now at war with Liberty Mutual. The adjuster is not your friend. Their job is to find reasons to deny your legitimate claim.
They make money denying your claim
Liberty Mutual, like all insurance companies, are in business to collect premiums and not pay claims. When they provide you the medical treatment and weekly benefits you deserve, they are losing money. Denying legitimate claims is how they make a ton of money.
The adjusters are trained to assume your claim is bogus, you are a liar, you are a cheat and you are trying to scam the system.
Not pretty. But you need to know the lay of the land. Like I said, my job is to tell you what you need to hear - not what you may want to hear.
No statements, don’t sign anything
Never give a written statement, recorded statement, sign any documents, sign any releases or authorizations. Don’t sign anything. The adjuster is only looking for reasons to deny your claim.
Don’t chit chat
Don’t talk to the adjuster. Be polite, but the more you talk to the adjuster the more likely you are going to mess up. Everything you say will be used against you in court.
Playing with a rattlesnake
I compare talking to the adjuster to playing with a rattlesnake. While some people may not get bit, most folks are not only going to get bit - but the bite is often fatal to your case. While you may eventually overcome the rattle snake venom - it may take years. You may go without medical treatment and/or benefits for years while trying to overcome your mistakes.
It is always best not to get bit at all.
It is all about telling the truth
Your number one priority at all times has to be your credibility. You must tell the truth about everything. Innocent misstatements and innocent omissions and the like can and will tank your case. I say it over and over again because it needs to be said.
Don’t think for a minute that because you are telling the truth that is is okay for you to talk to the adjuster, give a statement or sign authorization forms. In fact, the adjuster is counting on all of this so you will make one of these simple - but sometimes case ending mistakes. Don’t be that guy or gal.
