Who is Kevin Hall?
Okay, I realize that I take it to the edge from time to time. I have "discussed" the Department of Labor. I have "discussed" some of the largest Defense Base Act defense law firms. But that is what I do. I don’t pull punches. I bring it to you straight. That is what my clients expect of me. Today, it is my understanding that no law firm on the West Coast is filing more DBA claims than my law firm. I think there is a reason for that - because of my “no B.S. lawyer talk” approach.
So, in this article, I discuss Kevin Hall - Zurich North America. Mr. Kevin Hall is a Defense Base Act insurance adjuster at Zurich North America. It appears that Mr. Hall handles two type of claims. Catastrophic/ very serious injury DBA claims and DBA claims for claimants that live on the west coast.
Largest DBA law firm on the West Coast weighs in
Since my law firm is the largest DBA law firm on the west coast and we handle catastrophic DBA claims and very serious injury DBA claims - we see Kevin Hall on many of our cases.
That being said, I have never personally met Mr. Kevin Hall. Since my law firm has so many DBA claims - I sure would like to meet him face to face. It is always better to both “put a face to a name” and to have a personal relationship with folks that you do business with. I say business, because make no mistake about it - DBA insurance is a business. I'll bet Mr. Hall can be charming in person. You don't rise to his level in any industry without being able to do so, based upon what I have seen. But again, I have never met Mr. Hall in person.
I have only spoken to Mr. Hall on a few occasions. It seems that in most cases, as soon as my law firm is hired by a client where Mr. Hall is the adjuster - Zurich seems to lawyer-up. When that happens, that is not a bad thing for you - the client. I can’t remember Zurich hiring a lawyer for a case that Mr. Hall is the Zurich adjuster for, that I didn’t already have a decent relationship with the lawyer that was hired.
Don’t get me wrong here - I don’t socialize with any DBA defense attorneys or any DBA insurance adjusters. It is all business. But it is usually the same lawyers and the same DBA defense law firms across the country that I (and my law firm) end up dealing with. When you have as many DBA clients as we do - - you know the players, so to speak. That is a good thing for you. You want a lawyer that knows who is who.
Fact is, Mr. Hall and Zurich - and their lawyers - know that my firm will take Defense Base Act cases to trial against Mr. Hall and Zurich. In fact, I have beaten them recently in a DBA trial. That is what you want - a DBA lawyer that Mr. Hall and Zurich knows can and will take a case to trial and will win.
Don’t mistake this as a guarantee that I will always win. No one can do that. But I try and only take cases to trial that have a very, very good chance of winning. That is what you want your DBA lawyer to do also. That is - take the good cases to trial and settle the not so good cases. In doing so, the good cases get much better settlement offers. This helps you get a better settlement.
How to work with DBA insurance adjusters
Getting back to Mr. Hall and Zurich. When an outside lawyer recommends that compensation be paid or certain medical treatment be provided - it gives cover to the DBA insurance adjuster to actually provide them. In this instance, it may be easier for Mr. Hall to authorize the benefits. This is why it may actually be better if Zurich lawyers-up on your DBA case. (Read: Zurich hires an outside defense lawyer because you hired a DBA lawyer) In many instances having an outside insurance company lawyer on the case will result in clients getting their benefits paid.
Truth be told, I am not necessarily singling out Mr. Hall here. But based on what I see - - Zurich is one of the more “challenging” (I really debated what verb to use to describe Zurich - after further reflection and trying to avoid being sued by Zurich - I settled on the more politically correct word “challenging.” You might want to chose a more descriptive verb - but I toned it down a tad here.) DBA insurance companies that I deal with. In fact, Zurich may be THE most “challenging” DBA insurance company I deal with. If they are not THE most “challenging”, they are tied for THE most “challenging.”
Hey, this is not a scientific survey here. This is just based on what I see day to day. This is my opinion only based upon the folks that call my office.
So I have some questions for you: Is Zurich denying your legitimate DBA claim? Is Zurich not providing you weekly compensation for your DBA claim? Is Zurich not approving medical treatment that your doctor has recommended? Is Zurich not approving medical treatment that the doctor hired by Zurich recommended?
Always Tell The Truth
No matter what type of injury or how you were injured, you need to be frank and up-front about it with yourself, your attorney and your doctors. Do not lie or over-exaggerate anything. If you do, you will be in a worse situation then you already are.
Always tell the truth to the judge and to your attorney. Your credibility in court depends on your honesty. People are more likely to trust you and help you, if they can see your honest.
