My Workers Compensation weekly payment is late, what can I do?

The first payment of temporary compensation (i.e., your workers' comp check) must be made to you within 14 days after your employer has knowledge of your injury, unless your claim has been denied. After that, you are entitled to receive your temporary compensation payment every 2 weeks from the date of the first payment.

If the workers comp insurance company doesn't pay you promptly, the late payment "must" be increased by 10%. The insurance company is supposed to pay that even if you don't ask for it.

Which doesn't mean you shouldn't ask for the 10% penalty. As always, make the request in writing, with a proof of service.
