What is the Telephone Consumer Protection Act?

The Telephone Consumer Protection Act (TCPA) is a federal law that protects you from intrusive calls to your cell phone. It is illegal for any person or company to make a call to your cell phone with the use of an automatic telephone dialing system or an artificial or prerecorded voice.  


Companies often make use of these technologies when calling cell phones.  The only time these kinds of calls are allowed are for emergency purposes or if the cell phone owner has given the company express consent to call them at that number.

 

What is a Telemarketing call under the Act?

This is a call initiated by advertisers that offer or market products or services to consumers. Purely informational calls or those made for non-commercial purposes are not covered.
What is an Autodialed call?

An auto-dialed call is a telephone call by either a real person or pre-recorded message that is initiated through the use of an “autodialer,” or automatic number dialing system. These systems produce, store and call numbers using random or sequential number generators.


What is a covered call?

The statute recognizes “calls” as including not only those made to ground lines and wireless phones, but also messages sent via SMS text message.

 

What kind of system has to be used by the sender?

The TCPA defines an "automatic telephone dialing system" ("ATDS") as "equipment which has the capacity ... to store or produce telephone numbers to be called, using a random or sequential number generator; and ... to dial such numbers."

 

Does a text message qualify as a call under the Act?

A text message is a "call" within the meaning of the TCPA.

 

What if the call or text was not intended for me?

In most instances you can still bring a case even if the call or text was not intended for you.

 

What if I previously provided consent to calls or texts? Or What if I cancel my consent?

Even if you have provided prior consent to be called or texted - if you revoke the consent (i.e., tell them to stop calling or texting you and they continue to call or text you - then you can still bring a case.

 

What is a SMS?  What is a short message call?

SMS stands for Short Message Service.  It is also commonly referred to as a "text message". With a SMS, you can send a message of up to 160 characters to another device. Most cell phones will allow text messaging.

 

Should I delete the message?

No. You are going to need the message as evidence in your case.

 

What is SPAM?

Spam is the sending of thousands or even millions of cell phones of the same message, in an attempt to force the message on people who would not otherwise choose to receive it. Most spam is commercial advertising, often for dubious products, get-rich-quick schemes, or quasi-legal services. Spam costs the sender very little to send -- most of the costs are paid for by the recipient or the carriers rather than by the sender.

 

What is a robo call?

A robocall is a recorded message that’s pitching a product or service. It is called robo because it is made by a machine.

 

What is an autodialer?

An autodialer is a telephone machine that can make thousands of calls a minute.

 

What about random text messages?

It’s illegal for a company to send you a text message if it doesn’t have your permission, barring a few exceptions. If you get a random text message from a number you don’t recognize that says you won something or asks you to confirm some personal information - the first thing you should do is not delete the message.
